2. IGCC's General Obligations

• 2.1 The Indo-German Chamber of Industry and Commerce ("IGCC") shall organise the event at the venue on 24th October 2024 to 26th October 2024.
• 2.2 IGCC may, in its sole discretion, organise the event virtually or in a hybrid form on the stipulated dates or on any other suitable dates.
• 2.3 IGCC reserves the right to make changes to the schedules, details and contents of any program including a change of venue insofar as such changes do not materially change the aim or purpose of the event.
• 2.4 IGCC does not guarantee the attendance of any speaker, participant or attendee or any minimum number of participants or attendees.

3. Payment Terms

• 3.1 The participant shall pay the ticket prices in full at the time of registration.
• 3.2 Payment shall be made via credit cards/ debit cards/ net banking as accepted on the registration platform at the time of registration.
• 3.3 The ticket prices payable are subject to applicable goods and services tax and bank charges levied by the bank and the payment gateway.
• 3.4 Registration for this event is confirmed only after receipt by IGCC of the full payment of the ticket price(s). The participant will receive an email from IGCC or its representative to confirm his/her registration for this event. Please contact us at contactus@asiapacificconference.com if such an email confirmation is not received.
• 3.5 All ticket prices paid are non-refundable except in the event of cancellation by IGCC in the limited circumstances referred to in Clause 4.2 below.

4. Cancellation or Postponement

• 4.1 In the event that IGCC, in its sole reasonable discretion, is of the view that the event must be cancelled or postponed, neither party shall be liable for any losses or damages arising therefrom to the other party.
• 4.2 Notwithstanding the foregoing, in the event that IGCC, in its sole reasonable discretion, is of the view that the event must be cancelled due to the occurrence of any particular event(s) including but not limited to:
  • 4.2.1 In the event of cancellation by IGCC due to any change in applicable laws, rules, regulations, or guidelines adversely affecting the organisation of the event, or for any other reason leading to event cancellation, IGCC reserves the right to refund 20% (20 percent) of the participant's ticket price. However, it is clarified that in such circumstances, IGCC retains the remaining 80% (80 percent) of the ticket price paid.
  • 4.2.2 In the case of non-attendance of the event by a participant, no refund will be given.

5. Limitation of Liability

• 5.1 Please be aware that the food served at the event may contain or come into contact with common allergens, such as dairy, eggs, wheat, soybeans, tree nuts, peanuts, fish, shellfish or wheat. Whilst IGCC and the venue operators will take steps to minimize risks and safely handle the foods that contain potential allergens, please be advised that cross contamination may occur due to factors beyond their reasonable control.
• 5.2 Participants with food allergies or other nutritional concerns are advised to identify themselves and notify the manager of any dining operation at the venue of the nature of their allergies and/or ask for assistance. IGCC does not assume any liability for adverse reactions to foods consumed, or items one may come into contact with, while eating at the event.
• 5.3 Under no circumstances shall IGCC be held responsible or liable for any damage to or theft or loss of any property, goods, articles, or things, however placed, deposited, brought into or left at the venue by any person.
• 5.4 Notwithstanding any provision to the contrary, to the maximum extent permitted by law, IGCC's liability for any loss or damage as a result of, in connection with and/or in relation to this agreement including loss or damage caused by third parties, agents, sub-contractors or sub-suppliers shall be limited to the ticket price(s) payable under this agreement.
• 5.5 For the avoidance of doubt, nothing in this clause shall be construed as an exclusion of IGCC's liability for personal injury or death caused by its negligence or for fraud or fraudulent misrepresentation.
• 5.6 All participants must comply with all applicable laws, rules, regulations and orders of any governmental authority.
• 5.7 Participants must notify IGCC of any health conditions that contradict the Epidemic Disease Act (EDA) of 1897. IGCC shall not be liable for fines or penalties imposed on any participant as a result of such violation or non-compliance. IGCC also does not assume any liability if any registration to be denied entry to the event due to non-compliance.

6. Personal Data Protection

• 6.1 By participating in this event, the participant acknowledges and agrees that certain personal information, including but not limited to the date and place of birth, nationality, and passport number, name of parents, visa may be collected, and processed for the purposes of event management. The participant further consents to the sharing of this data with relevant authorities, including the Indian Authorities, in accordance with applicable laws and regulations.
• 6.2 The participant’s personal data will be disclosed to agencies, vendors, consultants to enable its provision of core ticketing services to IGCC. For example, the agency may process the participant’s personal data on behalf of IGCC to allow IGCC to learn more about their attendees during the ticket purchase, facilitate the transmission of emails to participants at the request of IGCC and process payments.
• 6.3 Where necessary, the participant's personal data may also be disclosed to the venue operators and/or evening reception partners of the event to enable them to ensure that the event is managed safely and smoothly.
• 6.4 Due to the nature of this event, photographs and audio or visual recording will be taken at this event by IGCC and its agents, consultants, representatives, partners, journalists and media at, before, during or after the event and they may be published on websites, in publications, newsletters, marketing materials and social media platforms of IGCC or any other APK organisers and/or broadcasted or livestreamed on television and social media platforms of third parties.
• 6.5 Due to the nature of this event, the participant's personal data may be disclosed to the German Chambers Abroad, the Association of German Chambers of Industry and Commerce (DIHK), the Asia-Pacific Committee of German Business (APA) and/or the German Federal Ministry of Economic Affairs and Climate Action (BMWK) and other necessary partners for the purpose of organising the event and any side events.
• 6.6 The collection, use, processing, and disclosure of personal data will be in accordance with APK's privacy statement (https://asiapacificconference.com/privacy_policy), as may be amended from time to time and available on APK's website.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India. The parties shall settle any dispute arising out of or in connection with this Agreement, in an amicable way. If no settlement can be reached within thirty days, then the dispute shall be referred to and finally resolved by an arbitral institution mutually agreed upon by the parties. The language of the arbitration shall be English.

Opt ins: 8. Evening Events

Dinner receptions will be hosted for the participants of the APK to take place in the evenings of 24 October 2024 and 25 October 2024.

• Yes, I am planning to attend the Welcome Reception on 24 October 2024.
• Yes, I am planning to attend the Dinner Reception on 25 October 2024.
• Yes, I agree to share my details to IGCC and their appointed event organisers and partners so they may contact me regarding the Welcome Evening or Dinner Reception and any other information regarding the Conference.
• Yes, I consent to share my information with IGCC and their designated event organisers and partners, allowing them to contact me about networking and marketing opportunities beyond the APK event.
• Yes, I do not want to attend any evening programme.

9. Option of connecting with other conference participants via the Apple/ Android App

An APK 2024 conference app can be downloaded via Google Play and Apple-store to all organisers and participants. The app informs about the programme and speakers and gives participants the possibility to share the fact that they are attending the conference. Please select how you wish to share your visibility on this app.

10. Entry Restrictions:

Access to evening events held during the APK period is restricted to the APK Corporate Partners, Organisers and Paid Delegates only. Other participants are not permitted to attend these evening events.

11. Venue Access:

Other participants are allowed access only to the APK event held at the Taj Palace venue.

12. Transportation:

IGCC, its associate partners, or members are not responsible for providing transportation to and from events outside the Taj venue. Transport if made available is subject to conditions of seat availability and other factors of first preference to APK Corporate Partners, Organisers and Paid Delegates of the event.

13. Access Control:

The event team members reserve the right to:

• 1. Restrict entry at any time.
• 2. Verify access passes at all times.
• 3. Ensure all attendees wear their allotted badges with the respective lanyard at all times while on the premises.

14. Right to Grant Access:

IGCC reserves the right to revoke access or revoke any of the above restrictions for any participant.
